We’re taking a short break and using this time to amplify the voices of other creators we love in the true crime space. While we’re enjoying our summer hiatus, we’ve got something dark and compelling to keep your earbuds company. We're dropping an episode from Sins & Survivors, a Las Vegas true crime podcast hosted by Shaun & John.

A tragic case of child custody gone wrong. On Easter Sunday 2019, Sean Babbitt was hopeful about his future and his fight for more time with his 3-year-old son. The next morning, during his weekly visitation, he was shot and killed by his ex-mother-in-law, a retired police detective

Sean Babbitt enjoyed a joyful Easter Sunday with his family on April 21, 2019, watching the Golden Knights and Game of Thrones, and playing with hula hoops with his nieces. Sean was in good spirits. His attorney had told him that he had a very good chance of modifying his custody agreement, and he was hopeful that he’d soon be spending more time with his 3-year-old son.

The next morning, Sean drove to his former mother-in-law’s house for his weekly supervised visitation with his son. While Sean was feeling positive about the future, his mother-in-law was distraught and decided to take matters into her own hands.

00:00:14.839 --> 00:00:18.280
Sean Babbitt enjoyed a joyful Easter Sunday with his family

6
00:00:18.320 --> 00:00:21.920
on April twenty first, twenty nineteen, watching The Golden Knights

7
00:00:21.920 --> 00:00:24.280
and Game of Thrones and playing with hula hoops with

8
00:00:24.320 --> 00:00:27.960
his nieces. Seawn was in good spirits. His attorney had

The next morning, Sean drove to his former mother in

13
00:00:38.280 --> 00:00:41.359
law's house for his weekly supervised visitation with his son.

14
00:00:42.320 --> 00:00:44.759
While Sean was feeling positive about the future, his mother

15
00:00:44.840 --> 00:00:47.840
in law was distraught and decided to take matters into

16
00:00:47.880 --> 00:00:54.560
her own hands.

17
00:00:55.759 --> 00:00:58.280
Hi and Welcome to Sins and Survivors, a Las Vegas

18
00:00:58.320 --> 00:01:02.079
true crime podcast focus on cases that deal with domestic violence,

19
00:01:02.280 --> 00:01:06.519
as well as missing persons and unsolved cases. I'm your host, Sean.

20
00:01:06.439 --> 00:01:07.599
And I'm your co host John.

21
00:01:08.480 --> 00:01:11.000
This week's story is similar to the story of Dennis

22
00:01:11.000 --> 00:01:13.920
and Ashley Prince, which we covered in episode thirty six.

23
00:01:14.599 --> 00:01:17.079
Ashley and Dennis were murdered by her ex father in

24
00:01:17.159 --> 00:01:20.200
law during a deposition in the custody case between Ashley

25
00:01:20.280 --> 00:01:23.480
and her ex husband. Her ex father in law, Joe Houston,

26
00:01:23.760 --> 00:01:27.239
was representing his son and Dennis, Ashley's husband, who was

27
00:01:27.239 --> 00:01:31.040
also an attorney, was representing his wife. Matters of family

28
00:01:31.120 --> 00:01:34.760
law and custody disputes can be painful, ugly, and contentious,

29
00:01:35.200 --> 00:01:37.760
and the case we have this week is another heartbreaking

30
00:01:37.840 --> 00:01:41.640
example of that. Sean Babbitt was a father to a

31
00:01:41.640 --> 00:01:43.719
three year old boy who was shot and killed by

32
00:01:43.719 --> 00:01:46.239
his ex mother in law during his scheduled visitation with

33
00:01:46.280 --> 00:01:49.120
his son. For me, this is an example of the

34
00:01:49.159 --> 00:01:51.719
court or officers of the court trying to do the

35
00:01:51.799 --> 00:01:55.920
right thing but ultimately creating a dangerous situation. I don't

36
00:01:55.920 --> 00:01:57.760
want to get ahead of ourselves, so let's start out

37
00:01:57.760 --> 00:01:59.159
by sharing what we know about Sean.

38
00:02:00.159 --> 00:02:03.280
Shaan Babbitt was born in Las Vegas on August twenty seventh,

39
00:02:03.400 --> 00:02:06.480
nineteen eighty six. One interesting fact we found out about

40
00:02:06.560 --> 00:02:08.639
him is that he had the same birthday as his

41
00:02:08.759 --> 00:02:12.680
father and also his son. His parents are Jennifer and Brian,

42
00:02:13.080 --> 00:02:15.879
and his stepdad is named Dan. He had an older

43
00:02:15.879 --> 00:02:20.240
brother named Chris and a younger sister named cassiel Sewan

44
00:02:20.319 --> 00:02:22.639
was a musician, which is something that runs in the family.

45
00:02:23.199 --> 00:02:25.599
Both his brother Chris and his sister Cassielle played in

46
00:02:25.639 --> 00:02:29.240
bands with him. According to an article about Chris's music career,

47
00:02:29.719 --> 00:02:32.439
their dad was a rocker and a hippie, and he

48
00:02:32.520 --> 00:02:37.039
played Black Sabbath while he vacuumed around my crib. Sewn

49
00:02:37.080 --> 00:02:40.159
played the guitar, sang, and also composed and published music

50
00:02:40.199 --> 00:02:44.199
on band camp. He loved Halloween, playing Dungeons and Dragons,

51
00:02:44.479 --> 00:02:48.120
metal music, and star Trek. He graduated from Cornado High

52
00:02:48.120 --> 00:02:50.639
School and worked as a manager for a limousine company

53
00:02:50.680 --> 00:02:53.560
and was also an uber driver. We are so grateful

54
00:02:53.560 --> 00:02:56.919
to his brother, stepdad, and sister and other family members

55
00:02:56.919 --> 00:02:59.120
and friends who were so open about Sean and what

56
00:02:59.199 --> 00:03:01.919
he meant to all of them. He was described as

57
00:03:01.960 --> 00:03:07.319
being generous, loving, kind, selfless, and brilliant. His brother called

58
00:03:07.400 --> 00:03:09.840
him a magnificent human being who was easy to love.

59
00:03:10.639 --> 00:03:12.520
He was a good person down to his core, and

60
00:03:12.560 --> 00:03:14.840
he showed that to everyone he ever met.

61
00:03:16.000 --> 00:03:18.520
Shawn married Erica in two thousand and eight, and the

62
00:03:18.560 --> 00:03:21.520
two of them lived with Erica's mother, Pamela Bordeaux, in

63
00:03:21.560 --> 00:03:24.599
the far northwest part of Las Vegas, near Floyd Lamb Park.

64
00:03:25.439 --> 00:03:28.000
Their son was born in August of twenty fifteen, and

65
00:03:28.039 --> 00:03:31.479
that November, Erica filed for divorce before their son was

66
00:03:31.520 --> 00:03:36.240
even three months old. According to Shawn's stepdad, Dan, Shawn

67
00:03:36.319 --> 00:03:39.759
had a passive personality and it was very much like

68
00:03:39.840 --> 00:03:42.120
him to do what his wife wanted. He didn't complain

69
00:03:42.199 --> 00:03:46.280
a lot after they divorced. His stepdad described it as

70
00:03:46.360 --> 00:03:49.240
getting Sean back, which could mean a few different things.

71
00:03:49.360 --> 00:03:52.000
Perhaps he felt that Sean was trapped in this relationship,

72
00:03:52.319 --> 00:03:54.000
or maybe they didn't get to spend as much time

73
00:03:54.039 --> 00:03:56.520
with him while he was married. Dan said he had

74
00:03:56.520 --> 00:03:58.879
lost a lot of weight and would tremble and shake

75
00:03:58.960 --> 00:04:01.159
with nerves for the first three to four months after

76
00:04:01.199 --> 00:04:05.719
their divorce. Under the divorce decree, Erica was granted sole

77
00:04:05.800 --> 00:04:09.039
legal and physical custody of the baby. Shawn was granted

78
00:04:09.080 --> 00:04:12.280
only one hour of visitation every week from seven am

79
00:04:12.400 --> 00:04:16.240
to eight am Monday mornings, contingent on him attending counseling,

80
00:04:16.879 --> 00:04:20.680
and these visits had to be supervised. Erica's mother, Pamela,

81
00:04:20.720 --> 00:04:23.040
would be the one to supervise these visits, and the

82
00:04:23.120 --> 00:04:27.199
visits were to take place inside of Pamela's home. Pamela

83
00:04:27.240 --> 00:04:30.040
Bordeaux was fifty one years old when Erica and Shawn divorced.

84
00:04:30.360 --> 00:04:33.199
She had worked as a Las Vegas Metropolitan Police detective.

85
00:04:33.480 --> 00:04:35.439
She was a single mom and joined the force in

86
00:04:35.480 --> 00:04:38.160
December of nineteen ninety three, when Erica was a young girl.

87
00:04:38.800 --> 00:04:41.319
She retired in twenty seventeen after being a part of

88
00:04:41.360 --> 00:04:43.879
Metro for nearly twenty five years.

89
00:04:44.839 --> 00:04:47.319
Before we get into what led up to Shawn's murder,

90
00:04:47.480 --> 00:04:49.839
I want to mention a few things. Sean was paying

91
00:04:49.879 --> 00:04:52.800
eight hundred dollars a month in child support, and Dan

92
00:04:52.879 --> 00:04:55.560
told reporters that the big love of his life was

93
00:04:55.560 --> 00:04:57.839
his little boy. He couldn't wait to see him for

94
00:04:57.879 --> 00:05:00.519
that hour he got to spend with him. We think

95
00:05:00.560 --> 00:05:04.480
any reasonable person would be confused or question this custody arrangement.

96
00:05:05.160 --> 00:05:07.279
Nevada is a state that leans toward a fifty to

97
00:05:07.319 --> 00:05:11.240
fifty custody split and one hour of supervised visitation each

98
00:05:11.279 --> 00:05:14.959
week is a very restrictive schedule so restrictive in fact,

99
00:05:15.120 --> 00:05:17.399
that we think it's natural to wonder what the cause

100
00:05:17.439 --> 00:05:21.120
of that was. We want to be clear that nowhere

101
00:05:21.160 --> 00:05:24.319
in our research was it ever alleged or noted anywhere

102
00:05:24.639 --> 00:05:27.759
that Sean had been abusive toward Erica, Pamela, or the baby.

103
00:05:28.240 --> 00:05:31.439
There were no stories of neglect, mental health concerns, or

104
00:05:31.480 --> 00:05:35.240
alcohol or substance use disorder issues, nor was it ever

105
00:05:35.319 --> 00:05:38.360
mentioned in the press what the required counseling was for.

106
00:05:39.319 --> 00:05:42.480
Dan said that he didn't know. The closest thing we

107
00:05:42.519 --> 00:05:45.480
could find to an explanation for this custody agreement was

108
00:05:46.079 --> 00:05:48.680
that Erica said that Sean had once referred to himself

109
00:05:48.720 --> 00:05:51.800
as an unfit parent. As these visits had to be

110
00:05:51.879 --> 00:05:55.399
supervised and held inside of Pamela's home, it's not clear

111
00:05:55.439 --> 00:05:58.120
to us how much of an opportunity Sean's family members,

112
00:05:58.519 --> 00:06:02.160
the baby's grandparents, or Shawn's siblings had to spend time

113
00:06:02.199 --> 00:06:05.360
with him. This arrangement lasted about three and a half

114
00:06:05.439 --> 00:06:08.879
years until April of twenty nineteen, when Shawn met with

115
00:06:08.920 --> 00:06:11.839
a lawyer and filed papers to increase his visitation with

116
00:06:11.920 --> 00:06:14.519
his son. The lawyer believed he had a very good

117
00:06:14.639 --> 00:06:18.360
chance of succeeding. During this time, Erica had moved on

118
00:06:18.519 --> 00:06:21.720
and had remarried very shortly after their divorce was finalized.

119
00:06:22.360 --> 00:06:24.240
She was no longer living at her mom's house and

120
00:06:24.279 --> 00:06:28.279
had recently had another baby. Shawn's stepfather, Dan, later told

121
00:06:28.319 --> 00:06:31.240
the court that Erica had asked Seawan for permission to

122
00:06:31.319 --> 00:06:33.759
change their son's last name to the name of her

123
00:06:33.800 --> 00:06:37.360
new husband, and Sean had refused. Dan also said that

124
00:06:37.399 --> 00:06:39.720
he knew that Erica was aware of Sean's petition to

125
00:06:39.759 --> 00:06:42.879
increase the time he could spend with his son, because

126
00:06:42.879 --> 00:06:46.680
she had started calling him frequently. In hindsight, the custody

127
00:06:46.720 --> 00:06:49.480
and visitation of their son was becoming a contentious issue,

128
00:06:49.600 --> 00:06:51.360
and things were escalating quickly.

129
00:06:52.439 --> 00:06:54.839
As we mentioned in the opening of the episode, April

130
00:06:54.839 --> 00:06:59.279
twenty first, twenty nineteen, was Easter Sunday that year. Shawn's mom, Jennifer,

131
00:06:59.319 --> 00:07:02.000
described it as a Golden Knight's Game of Thrones Easter

132
00:07:02.079 --> 00:07:04.680
Sunday and said that Sean was in great spirits that

133
00:07:04.759 --> 00:07:08.040
day playing with his nieces. The next morning, Monday, the

134
00:07:08.040 --> 00:07:11.079
twenty second, Sean drove to Pamela's house to enjoy his

135
00:07:11.160 --> 00:07:14.680
one hour visitation with his son. Everything seemed to go smoothly,

136
00:07:14.800 --> 00:07:16.519
and at the end of the visit, around eight o

137
00:07:16.639 --> 00:07:19.600
five am, Erica led their son upstairs so he could

138
00:07:19.680 --> 00:07:22.120
use the bathroom. Sean was putting his shoes on and

139
00:07:22.120 --> 00:07:25.319
getting ready to leave. Before she could get her son

140
00:07:25.360 --> 00:07:29.000
to the toilet, Erica heard multiple gunshots coming from downstairs.

141
00:07:29.399 --> 00:07:33.399
She quickly called nine one one. Las Vegas Metro officers

142
00:07:33.399 --> 00:07:35.920
approached the house and initially treated it as a barricade

143
00:07:35.959 --> 00:07:39.040
situation where they needed to get Erica, her son, and

144
00:07:39.040 --> 00:07:41.920
Pamela out of the house safely. They knew a shooting

145
00:07:41.959 --> 00:07:44.120
had occurred in the home, but didn't have all the details.

146
00:07:44.720 --> 00:07:47.480
Erica herself was unsure about what happened. She would later

147
00:07:47.519 --> 00:07:50.000
state she didn't hear any argument, shouting, or any kind

148
00:07:50.000 --> 00:07:53.879
of disturbance before she heard the gunshots. Police used a

149
00:07:53.920 --> 00:07:56.560
ladder to evacuate Erica and her son from the second

150
00:07:56.600 --> 00:08:01.360
floor of the house. After twenty six minutes, Pamela exited

151
00:08:01.360 --> 00:08:03.279
the home and surrendered to the police, and she was

152
00:08:03.319 --> 00:08:07.560
placed in handcuffs. Bodycam footage shows an officer questioning Pamela

153
00:08:07.600 --> 00:08:11.720
about the shooting in the house. Metro officer is Shawn

154
00:08:11.800 --> 00:08:17.560
down Bordeaux, Yes Metro officer, is he four nineteen? Bordeaux,

155
00:08:17.759 --> 00:08:22.240
I don't know, Metro officer. Does he appear like he's dead? Bordeaux?

156
00:08:22.279 --> 00:08:26.480
I don't know, Metro officer. Is he moving? Bordeaux? I

157
00:08:26.519 --> 00:08:29.879
don't think so. Metro Officer. Do you hear any moaning

158
00:08:30.000 --> 00:08:33.519
anything like that? Bordeaux? No, Metro officer.

159
00:08:33.799 --> 00:08:33.879
No.

160
00:08:34.600 --> 00:08:37.600
Is he holding the gun or is the gun near him? Bordeaux?

161
00:08:37.600 --> 00:08:40.480
It was my gun, Metro officer, it was your gun.

162
00:08:40.600 --> 00:08:43.759
Where is it at? The officer then repeats himself twice,

163
00:08:43.759 --> 00:08:47.679
saying did you shoot him or did he shoot himself? Bordeaux,

164
00:08:47.759 --> 00:08:51.440
I'm always armed when he comes, I shot him. Metro officer.

165
00:08:51.720 --> 00:08:54.360
Huh you shot him? She nods yes.

166
00:08:55.360 --> 00:08:58.320
When the police entered the home, they found Sean dead

167
00:08:58.440 --> 00:09:01.240
on the living room floor with his shoes nearby. There

168
00:09:01.279 --> 00:09:04.159
was no sign of a struggle in the house. The

169
00:09:04.200 --> 00:09:07.039
autopsy would reveal that Sean had been shot ten or

170
00:09:07.080 --> 00:09:09.840
eleven times. He had been shot in the top of

171
00:09:09.879 --> 00:09:12.480
the head and three times through the back, and he

172
00:09:12.480 --> 00:09:16.320
had significant defensive wounds to his hands that indicated that

173
00:09:16.399 --> 00:09:18.559
he had had his hands up to deflect the attack.

174
00:09:19.519 --> 00:09:22.279
Only one weapon, Pamela's gun, was found in the home.

175
00:09:23.320 --> 00:09:25.879
According to Dan, Seawan had no way to retreat from

176
00:09:25.879 --> 00:09:28.559
the room, and he was shot by Bordeaux as she

177
00:09:28.639 --> 00:09:30.799
was standing at the top of the stairs firing down

178
00:09:30.840 --> 00:09:35.000
at him. Sean's brother, Chris, would later claim that Sean

179
00:09:35.039 --> 00:09:36.919
had been shot while he was putting his shoes on,

180
00:09:37.240 --> 00:09:42.840
Although Detective Gary King couldn't confirm that. Erica, her new husband,

181
00:09:43.200 --> 00:09:46.320
and Pamela's friend Mark were all interviewed at the scene.

182
00:09:46.519 --> 00:09:48.919
Mark is also a Metro detective who happened to be

183
00:09:48.960 --> 00:09:52.159
on duty and responded to the call. When they were interviewed,

184
00:09:52.279 --> 00:09:54.360
all three told police that they thought the motive for

185
00:09:54.360 --> 00:09:57.159
the shooting was that Sean was trying to increase custody

186
00:09:57.320 --> 00:10:01.279
and Pamela was distraught with the situation. When Pamela was

187
00:10:01.279 --> 00:10:04.559
taken into custody, officers noted that she had no blood

188
00:10:04.639 --> 00:10:08.320
or tissue on her hands, face, or clothes. Her face

189
00:10:08.360 --> 00:10:11.399
and hands had no injuries, no marks, no scrapes, no

190
00:10:11.480 --> 00:10:15.519
broken fingernails. According to the RJ Chief Deputy District Attorney

191
00:10:15.519 --> 00:10:19.799
Michelle Fleck called the shooting a completely unprovoked attack and

192
00:10:19.879 --> 00:10:21.399
an absolute execution.

193
00:10:22.759 --> 00:10:25.600
Pamela's explanation was that she had acted in self defense

194
00:10:25.840 --> 00:10:29.000
that Sean was a violent and dangerous person. Two days

195
00:10:29.000 --> 00:10:32.799
after she was arrested, her attorneys, Robert Draskovich and Michael Horvath,

196
00:10:33.120 --> 00:10:35.480
gave a statement to the press where they claimed Sean

197
00:10:35.639 --> 00:10:38.159
was a deviant. They said he had a dark side

198
00:10:38.200 --> 00:10:41.240
that it's likely his family members were unaware of. They

199
00:10:41.240 --> 00:10:43.399
explained that Pamela was a grandmother who was trying to

200
00:10:43.399 --> 00:10:47.039
protect herself, her daughter, and her grandson. The attorney stated

201
00:10:47.080 --> 00:10:50.320
that they had reached this conclusion based on the custody agreement.

202
00:10:50.720 --> 00:10:53.639
They argued that the visitation being supervised in just once

203
00:10:53.679 --> 00:10:56.039
a week for one hour was evidence that there had

204
00:10:56.080 --> 00:10:58.440
to be a reason for that, and they claimed they

205
00:10:58.440 --> 00:11:01.279
would be launching a full investigation into the reasons why.

206
00:11:02.879 --> 00:11:05.840
Shawn's family and his stepdad Dan in particular, had a

207
00:11:05.919 --> 00:11:08.600
lot to say about this. As you might imagine, Dan

208
00:11:08.679 --> 00:11:11.759
believed that the motive was very straightforward. I think for

209
00:11:11.799 --> 00:11:13.840
the first time he stood his ground and said, no,

210
00:11:14.080 --> 00:11:16.399
I'm getting more time with my son. I don't think

211
00:11:16.440 --> 00:11:18.960
she could stand that he wanted more access, so he

212
00:11:19.039 --> 00:11:21.720
served them with papers and he would have gotten more access,

213
00:11:21.759 --> 00:11:25.360
and the next visit he was murdered. This is just shocking.

214
00:11:25.600 --> 00:11:27.679
Sean filed for more time with his son, and this

215
00:11:27.720 --> 00:11:30.840
is what happened. Seawan was a very peaceful boy and

216
00:11:30.879 --> 00:11:33.759
he wouldn't harm a fly. I know they know that.

217
00:11:35.039 --> 00:11:37.919
While this would be the motive that prosecutors stress during trial,

218
00:11:38.039 --> 00:11:41.440
the investigation did also reveal that during their marriage and

219
00:11:41.519 --> 00:11:44.879
before their son was born, Pamela and Erica convinced Sean

220
00:11:44.960 --> 00:11:47.720
that he needed a life insurance policy. They took out

221
00:11:47.720 --> 00:11:50.679
a policy on him, with Erica as the primary beneficiary

222
00:11:50.759 --> 00:11:53.840
and Pamela as the secondary. The policy was worth three

223
00:11:53.960 --> 00:11:56.720
hundred and five thousand dollars and a claim was made

224
00:11:56.720 --> 00:11:59.559
on that policy on April twenty fourth, just two days

225
00:11:59.600 --> 00:12:02.799
after his murder. Though her attorneys tried to have the

226
00:12:02.879 --> 00:12:06.039
charges dropped based on self defense, they failed, as the

227
00:12:06.039 --> 00:12:10.600
prosecutors explained, a general claim of dangerousness is both unreasonable

228
00:12:10.799 --> 00:12:13.519
and not a legal defense to murder. This case is

229
00:12:13.559 --> 00:12:16.720
a clear demonstration that Bordeau's reaction to other family members

230
00:12:16.759 --> 00:12:20.440
seeking time with her grandchild is to resort to extreme violence.

231
00:12:22.000 --> 00:12:24.759
As we stated, initially, she was held without bail and

232
00:12:24.840 --> 00:12:27.879
the judge denied her request to be released, stating that

233
00:12:27.960 --> 00:12:31.080
she was a threat to the Babbitt family. About two

234
00:12:31.120 --> 00:12:34.639
months later, on June twenty ninth, twenty nineteen, she had

235
00:12:34.639 --> 00:12:37.080
a separate bail hearing and bail was set at one

236
00:12:37.080 --> 00:12:41.000
million dollars. Bordeaux posted that bail and was placed on

237
00:12:41.000 --> 00:12:45.600
house arrest pending trial. The trial didn't begin until June

238
00:12:45.600 --> 00:12:48.879
of twenty twenty four and lasted six days. Erica was

239
00:12:48.919 --> 00:12:51.000
a witness for the state and she testified about what

240
00:12:51.039 --> 00:12:54.000
we already shared here, that the visit was normal, there

241
00:12:54.039 --> 00:12:56.559
was no argument or fighting, and that she didn't hear

242
00:12:56.600 --> 00:13:01.080
anything before she heard the gunshots. Pamela's friend, the detective,

243
00:13:01.440 --> 00:13:03.279
testified that he knew her to be a steady and

244
00:13:03.320 --> 00:13:06.320
calm person, but the Saturday night before the shooting, he

245
00:13:06.360 --> 00:13:09.480
said she was distraught. She told him that she was

246
00:13:09.559 --> 00:13:12.960
upset about the possibility of Sean getting custody, saying family

247
00:13:13.000 --> 00:13:15.080
courts don't give a damn and they want to give

248
00:13:15.120 --> 00:13:19.399
fifty to fifty custody. Forensic evidence also showed that Pamela

249
00:13:19.519 --> 00:13:21.799
was not close to Sean when the shooting took place.

250
00:13:22.200 --> 00:13:24.279
She was at a distance of at least two feet,

251
00:13:24.559 --> 00:13:26.840
which is why she didn't have any blood evidence on her.

252
00:13:26.879 --> 00:13:30.039
After the shooting, It's also important to note that two

253
00:13:30.120 --> 00:13:34.159
separate witnesses testified they heard several gunshots and then, after

254
00:13:34.200 --> 00:13:38.799
a pause, several more gun shots. There was also evidence

255
00:13:38.840 --> 00:13:43.080
that Bordeaux had manipulated the scene following the shooting. One

256
00:13:43.080 --> 00:13:45.440
of Sean's socks had blood on it, and it was

257
00:13:45.480 --> 00:13:48.600
demonstrated by evidence that the likely cause was that Pamela

258
00:13:48.639 --> 00:13:51.360
had taken the sock off his foot and used it

259
00:13:51.399 --> 00:13:53.600
to move the shell casings into one part of the

260
00:13:53.679 --> 00:13:57.120
room in a close cluster. She didn't get them all, though,

261
00:13:57.279 --> 00:13:59.720
and prosecutors would argue that was because they were hidden

262
00:13:59.799 --> 00:14:02.399
in the room, under a shoe, behind a door, and

263
00:14:02.559 --> 00:14:07.200
even under Sean. The prosecutors emphasized that Pamela was a

264
00:14:07.200 --> 00:14:10.000
creature of habit. She had a routine for those Monday

265
00:14:10.000 --> 00:14:13.279
morning visits where she would come downstairs, open the blinds

266
00:14:13.320 --> 00:14:15.840
to see if Sean was at the door, then leave

267
00:14:15.879 --> 00:14:18.320
the blinds open for the visit, and then close them

268
00:14:18.360 --> 00:14:21.840
after the visit. She would also closely supervise those visits,

269
00:14:22.039 --> 00:14:24.960
and she would have her gun, pepper spray, and handcuffs

270
00:14:25.000 --> 00:14:27.799
at the ready. On the day of the murder, however,

271
00:14:28.039 --> 00:14:30.960
she kept the blinds closed. The blood spatter evidence in

272
00:14:31.000 --> 00:14:33.000
the home confirmed they were shut at the time of

273
00:14:33.000 --> 00:14:37.440
the murder. For the prosecution, this meant premeditation, not self defense.

274
00:14:38.120 --> 00:14:40.639
The defense made the argument that Sean had been erratic

275
00:14:40.720 --> 00:14:44.000
lately and that he may have had a propensity for violence.

276
00:14:44.480 --> 00:14:47.960
He was characterized as a jealous and emasculated ex husband.

277
00:14:48.440 --> 00:14:51.639
The defense had an expert clinical and forensic psychologist, John

278
00:14:51.679 --> 00:14:55.480
Paul Garrison, who did an assessment of Sean based on

279
00:14:55.519 --> 00:14:58.559
what the defendant told him and emails and text messages

280
00:14:58.639 --> 00:15:01.679
he had sent to Erica during their marriage. According to

281
00:15:01.720 --> 00:15:04.480
his assessment, Pamela had a reason to be afraid of Sean.

282
00:15:04.960 --> 00:15:06.399
We have more to say about this when we get

283
00:15:06.440 --> 00:15:10.000
into the prosecution's closing arguments. They also claimed that Seawn

284
00:15:10.120 --> 00:15:12.960
was still upset over his divorce and Erica's new relationship.

285
00:15:13.360 --> 00:15:15.360
He was also alleged to be jealous of the newborn

286
00:15:15.399 --> 00:15:17.519
that Erica had with her new husband in December of

287
00:15:17.519 --> 00:15:20.919
twenty eighteen. Just a remind her here that Erica remarried

288
00:15:20.960 --> 00:15:23.200
just a few days after her divorce was finalized in

289
00:15:23.240 --> 00:15:25.879
twenty sixteen, so they had been split for about three

290
00:15:25.960 --> 00:15:28.360
years by the time the shooting occurred, and the baby

291
00:15:28.360 --> 00:15:31.840
had been born about five months earlier. Pamela took the

292
00:15:31.840 --> 00:15:34.360
stand in her own defense and described that she went

293
00:15:34.399 --> 00:15:36.080
to open the front door of the house to let

294
00:15:36.120 --> 00:15:38.440
Sean out, and when she turned around, he was coming

295
00:15:38.440 --> 00:15:41.200
down the stairs toward her with his hands outstretched like

296
00:15:41.279 --> 00:15:44.360
he was going to strangle her. The defense explained that

297
00:15:44.399 --> 00:15:47.120
Bordeaux had an excellent record of service both in Metro

298
00:15:47.240 --> 00:15:49.639
and in the military, and that she had no duty

299
00:15:49.679 --> 00:15:52.759
to retreat in her own home. Her killing was justified

300
00:15:52.919 --> 00:15:56.440
based on Shawn's deviant behavior. I think this is a

301
00:15:56.440 --> 00:15:59.120
good time to read the statement Shawn's brother Chris made

302
00:15:59.120 --> 00:16:04.279
about his brother before the trial started. I want to

303
00:16:04.320 --> 00:16:08.200
help prepare friends, family, and supporters for the abhorrent ugliness

304
00:16:08.200 --> 00:16:12.080
that lies ahead. The assassination attempt of my brother's character

305
00:16:12.240 --> 00:16:15.159
will be heart wrenching and enraging, but we must stand

306
00:16:15.279 --> 00:16:18.279
united and continue to always show Shan in his true light,

307
00:16:18.600 --> 00:16:20.519
as the true light he was in so many of

308
00:16:20.559 --> 00:16:24.440
our lives, now that his has been barbarically taken. In

309
00:16:24.480 --> 00:16:27.559
their first statement, the murderer's legal defense team has already

310
00:16:27.600 --> 00:16:30.720
cited untruth. This may very well set the tone for

311
00:16:30.759 --> 00:16:34.879
what is to come. Understand, there was nothing dangerous about

312
00:16:34.919 --> 00:16:38.879
my brother, my dearest friend, my daughter and niece's favorite uncle,

313
00:16:39.279 --> 00:16:43.320
my inspiration in art and life, my soulmate, my gentle

314
00:16:43.360 --> 00:16:46.559
and ingenious brother, Sean Babbitt was murdered in cold blood,

315
00:16:46.919 --> 00:16:49.720
and because all the evidence leads to this fact, the

316
00:16:49.799 --> 00:16:53.000
smear campaign to malign and distort his true character has

317
00:16:53.039 --> 00:16:56.320
already begun. Because there is no way to interpret the

318
00:16:56.360 --> 00:17:00.200
brutal slaying and summary execution of my brother in any

319
00:17:00.240 --> 00:17:03.279
other way than murder based on all the physical evidence,

320
00:17:03.639 --> 00:17:06.640
the legal defense team for Shawn's murderer are already taking

321
00:17:06.680 --> 00:17:09.319
to the media to try and manipulate his image with

322
00:17:09.440 --> 00:17:13.799
half truth and grossly simplified or exaggerated labels to try

323
00:17:13.799 --> 00:17:16.880
an engender doubt and discust in the public eye by

324
00:17:16.880 --> 00:17:19.920
presenting a one sided story for which they require no

325
00:17:20.039 --> 00:17:23.480
burden of proof or evidence beyond its introduction. Because you

326
00:17:23.559 --> 00:17:26.599
cannot legally slander the dead, and they therefore have no

327
00:17:26.680 --> 00:17:29.759
consequences to keep their tactics from becoming more than mudslinging

328
00:17:29.799 --> 00:17:33.920
without evidentiary foundation, they intend to distort his true character

329
00:17:34.160 --> 00:17:37.279
by painting my kind hearted, sweet, generous, and tender brother

330
00:17:37.599 --> 00:17:41.079
as aggressive or possibly even stretch it as far as

331
00:17:41.119 --> 00:17:45.480
to portray as deviant. The killer's defense team is strategically

332
00:17:45.519 --> 00:17:48.759
saying the word deviant with specific intent, and they are

333
00:17:48.799 --> 00:17:52.240
coupling the word deviant with statements about his child intentionally

334
00:17:52.599 --> 00:17:54.279
so that when you think of those two things, you

335
00:17:54.279 --> 00:17:56.920
will associate deviants and children, and you will make your

336
00:17:56.960 --> 00:18:01.880
own assumptions by drawing horrific conclusions based on no facts whatsoever.

337
00:18:02.440 --> 00:18:04.960
In the court of public opinion, their statements may run

338
00:18:05.039 --> 00:18:09.480
rampant with suggestion, without factual support, and without objection or rebuttal,

339
00:18:09.759 --> 00:18:12.839
allowing the public imagination to form its opinion based solely

340
00:18:12.880 --> 00:18:15.880
on the half truce and outright untruths they are being fed.

341
00:18:16.359 --> 00:18:18.640
The defense has no evidence to support their case on

342
00:18:18.720 --> 00:18:21.440
legal grounds, so they will say anything they can to

343
00:18:21.480 --> 00:18:24.440
try and breed doubt. The sickening way in which my

344
00:18:24.519 --> 00:18:28.000
brother was literally shot to pieces is the only obscene

345
00:18:28.079 --> 00:18:30.640
fact of this case that should turn your stomach or

346
00:18:30.640 --> 00:18:34.039
sway your opinion. They want to introduce and extrapolate wild

347
00:18:34.119 --> 00:18:36.839
what if ideas to sow the seeds of doubt throughout

348
00:18:36.880 --> 00:18:40.400
the public opinion via the media because they know Sean

349
00:18:40.519 --> 00:18:43.279
is not on trial and no longer alive to defend himself,

350
00:18:43.640 --> 00:18:46.079
and thus they do not have to prove their allegations.

351
00:18:46.319 --> 00:18:49.240
They only have to introduce loose possibilities to poison the

352
00:18:49.279 --> 00:18:52.680
public well with the stuff of fiction or at most

353
00:18:52.799 --> 00:18:55.839
private communications from which they will likely try and stretch

354
00:18:55.880 --> 00:19:00.319
and squeeze far fetched ill intention using contextless snapshot of

355
00:19:00.359 --> 00:19:03.880
his life. Shawn was utterly devoted to his son. With

356
00:19:03.920 --> 00:19:06.680
the best intentions, and in a civil and peaceable manner,

357
00:19:06.960 --> 00:19:09.799
he pursued the legal means to regain the custody rights

358
00:19:09.839 --> 00:19:12.680
that he had been manipulated and bullied into signing away.

359
00:19:13.240 --> 00:19:16.680
His attorney was immensely confident that Shawn would absolutely regain

360
00:19:16.720 --> 00:19:18.759
the rights to see his son he loved so Dearly

361
00:19:19.359 --> 00:19:21.720
the week after his attorney filed and served the papers

362
00:19:21.759 --> 00:19:25.359
that would ensure Sean would regain his rightful custody, Shawn

363
00:19:25.519 --> 00:19:27.599
was murdered by a member of the family who received

364
00:19:27.599 --> 00:19:31.000
those papers. I implore you to share this story and

365
00:19:31.039 --> 00:19:33.799
to stand with us in unity to present the true

366
00:19:33.839 --> 00:19:36.839
and beautiful Sean Babbitt admissed the ugliness to come.

367
00:19:38.000 --> 00:19:40.839
Earlier in the episode, we mentioned that we were confident

368
00:19:40.839 --> 00:19:43.519
there was no evidence of Sean being abusive or negligent,

369
00:19:44.119 --> 00:19:47.480
as no specific evidence came to trial, and while some

370
00:19:47.640 --> 00:19:50.640
text messages were reported in the press or on that later,

371
00:19:51.119 --> 00:19:56.000
there were never any allegations of Sean physically harming Erica, Pamela,

372
00:19:56.240 --> 00:19:59.480
or his son or anyone else for that matter. We think,

373
00:19:59.559 --> 00:20:02.359
due to Pa Simla's defense for the shooting that something

374
00:20:02.400 --> 00:20:05.319
would have come out about that, but it hasn't. As

375
00:20:05.440 --> 00:20:08.160
Chris predicted. During the trial, the defense alluded to Sean

376
00:20:08.240 --> 00:20:12.440
being deviant, but nothing specific about his relationships or past

377
00:20:12.559 --> 00:20:15.559
actions with his son, Erica or Pamela was brought into evidence.

378
00:20:16.440 --> 00:20:19.799
During her closing argument, d A. Fleck dismantled the defense

379
00:20:19.920 --> 00:20:24.200
argument piece by piece. First, the forensic evidence simply didn't

380
00:20:24.240 --> 00:20:26.960
match Pamela's story and testimony, and the fact that she

381
00:20:27.000 --> 00:20:29.839
had purposely moved the shell casings to try to match

382
00:20:29.839 --> 00:20:33.240
her story was particularly damning. She had shot him ten

383
00:20:33.440 --> 00:20:38.119
times and never missed a single shot. Bordeaux testified that

384
00:20:38.160 --> 00:20:40.720
she shot and emptied her gun at Sean, but two

385
00:20:40.799 --> 00:20:44.039
independent witnesses had heard two sets of shots with a

386
00:20:44.079 --> 00:20:47.079
pause in between the state concluded that she had shot

387
00:20:47.160 --> 00:20:49.960
him a few times and then a few more times

388
00:20:50.039 --> 00:20:54.039
to make sure that he was dead. Pamela also waited

389
00:20:54.079 --> 00:20:57.559
twenty six minutes before exiting the house to make sure

390
00:20:57.640 --> 00:21:02.240
he didn't survive. The events stated that Sean was upset

391
00:21:02.240 --> 00:21:05.480
about Erica's new baby, but Fleck explained that it was

392
00:21:05.519 --> 00:21:08.240
over a year earlier that Sean found out she was pregnant,

393
00:21:08.400 --> 00:21:11.440
and he had congratulated her when he had heard and

394
00:21:11.480 --> 00:21:13.680
if that were true, why would he attack Pamela and

395
00:21:13.720 --> 00:21:16.480
not Erica. In one of the most moving parts of

396
00:21:16.519 --> 00:21:19.519
the trial, Fleck played a video Sean had recorded the

397
00:21:19.519 --> 00:21:21.880
morning of the murder. It was a selfie video of

398
00:21:21.960 --> 00:21:25.039
himself singing Elton John's Your Song. He then wished his

399
00:21:25.079 --> 00:21:27.799
girlfriend a good day and blew her a kiss. Michel

400
00:21:27.920 --> 00:21:30.359
explained that Sean was in love, he was happy, and

401
00:21:30.400 --> 00:21:33.079
he was hopeful about finally having more time with his son.

402
00:21:33.720 --> 00:21:36.160
The bottom line was he had no reason or motive

403
00:21:36.200 --> 00:21:40.119
to attack Pamela, especially three years after the visitations had begun.

404
00:21:40.839 --> 00:21:42.759
In her own testimony, she had stated that he had

405
00:21:42.799 --> 00:21:45.640
never provoked her or done anything violent to her in

406
00:21:45.759 --> 00:21:49.400
any of the previous one hundred and fifty six visitation sessions.

407
00:21:50.559 --> 00:21:52.559
And lastly, why would he risk it when he had

408
00:21:52.559 --> 00:21:55.200
good news from his attorney, but also when he knew

409
00:21:55.200 --> 00:21:59.480
that she's always armed during visitation. Fleck called this an

410
00:21:59.480 --> 00:22:02.680
active revival for asking for more visitation with his son,

411
00:22:03.160 --> 00:22:06.000
saying that Pamela was losing control of the situation and

412
00:22:06.039 --> 00:22:10.359
it acted as judge, jury and literal executioner. The state

413
00:22:10.440 --> 00:22:12.720
asked for a conviction of first degree murder.

414
00:22:13.720 --> 00:22:16.279
In the defense's closing argument, the part I was able

415
00:22:16.279 --> 00:22:19.160
to watch was centered on how it was reasonable for

416
00:22:19.200 --> 00:22:21.519
Pamela to be scared and that she had been a

417
00:22:21.519 --> 00:22:25.160
good cop and a good soldier. After about three hours

418
00:22:25.160 --> 00:22:28.480
of deliberation, the jury returned a guilty verdict of first

419
00:22:28.480 --> 00:22:32.039
degree murder with the use of a deadly weapon. During

420
00:22:32.039 --> 00:22:35.000
the sentencing hearing, Michelle Fleck stressed that at no point

421
00:22:35.079 --> 00:22:38.960
had Bordeaux ever taken any personal responsibility or shown any

422
00:22:39.000 --> 00:22:42.400
remorse for killing the father of her grandchild. Bordeaux had

423
00:22:42.400 --> 00:22:45.160
taken away his son's right to have a relationship with

424
00:22:45.200 --> 00:22:49.000
his father. She also noted that in the sentencing memorandum

425
00:22:49.000 --> 00:22:51.960
the defense had prepared that it was once again focused

426
00:22:52.000 --> 00:22:55.079
on what Pamela thought about Sean the whole deviant thing,

427
00:22:55.359 --> 00:22:59.079
which the prosecution called delusions. She told the judge that

428
00:22:59.119 --> 00:23:01.759
the assessment that the Diffe had presented at trial was backed

429
00:23:01.759 --> 00:23:04.599
by an expert whoever had the opportunity to meet Sean.

430
00:23:04.920 --> 00:23:07.359
It was entirely based on what Pamela had told him

431
00:23:07.440 --> 00:23:10.160
and text messages that had been taken out of context

432
00:23:10.160 --> 00:23:13.359
as part of a conversation Sean had with Erica during

433
00:23:13.440 --> 00:23:17.799
their marriage. Da Fleck was notably irritated about the report,

434
00:23:17.839 --> 00:23:21.079
and while she didn't accuse anyone outright, she reminded the

435
00:23:21.160 --> 00:23:23.640
judge that the assessment must have been leaked to the media,

436
00:23:24.559 --> 00:23:27.920
and the media had done tabloid reporting revealing that report

437
00:23:28.200 --> 00:23:31.160
without investigating any of the lies in the document. The

438
00:23:31.200 --> 00:23:33.880
implication here is that the defense had attempted to poison

439
00:23:33.880 --> 00:23:36.599
the jury pool and the court of public opinion by

440
00:23:36.640 --> 00:23:40.599
releasing that report. Again, what Chris wrote years earlier seemed

441
00:23:40.599 --> 00:23:43.720
to be true. The defense said that Pamela was sorry

442
00:23:43.759 --> 00:23:46.000
for what happened and asked for a lighter sentence because

443
00:23:46.000 --> 00:23:48.960
of her age. Pamela was sixty at the time, and

444
00:23:49.039 --> 00:23:52.559
even the judge acknowledged that the minimum sentence could be

445
00:23:52.599 --> 00:23:55.960
a life sentence for her. Chris was present to give

446
00:23:55.960 --> 00:23:58.839
a statement during the hearing. He first read a statement

447
00:23:58.880 --> 00:24:01.279
from their mom, Jennifer, where she talked about how Shan's

448
00:24:01.319 --> 00:24:03.319
last day had been a day filled with joy, love

449
00:24:03.359 --> 00:24:06.160
and hope. Chris choked back tears as he told the

450
00:24:06.200 --> 00:24:08.440
court that his little brother was his favorite person and

451
00:24:08.480 --> 00:24:11.039
his best friend. He was the other side of his coin,

452
00:24:11.200 --> 00:24:13.839
his soulmate, and the void would not fill and it

453
00:24:13.880 --> 00:24:17.119
couldn't be fixed. He said he aspired to be like Sewan.

454
00:24:17.240 --> 00:24:19.799
Even though he was the big brother, he was closer

455
00:24:19.839 --> 00:24:22.880
than a twin to him. Chris explained that he had

456
00:24:22.920 --> 00:24:24.720
been trying to hold it together for his wife and

457
00:24:24.759 --> 00:24:26.920
his two kids and the rest of his family, but

458
00:24:27.039 --> 00:24:31.160
Seawan was gone for nothing and for no reason. His stepdad,

459
00:24:31.240 --> 00:24:33.559
Dan also gave a statement. He thanked the judge and

460
00:24:33.599 --> 00:24:36.680
shared some information about how he viewed his son's relationship

461
00:24:36.680 --> 00:24:39.240
with Eric and Pamela. He said he wanted him to

462
00:24:39.240 --> 00:24:41.880
stay away from them and that it had been horrific

463
00:24:41.960 --> 00:24:43.960
living with the fact that he wanted to protect Seawan

464
00:24:44.000 --> 00:24:46.640
from them, but he couldn't. He said that his wife,

465
00:24:46.680 --> 00:24:48.920
Jennifer still cries every Monday morning.

466
00:24:50.519 --> 00:24:54.240
District Court Judge Carly Kearney said Bordeaux was a successful

467
00:24:54.240 --> 00:24:57.119
police officer but a terrible mother in law and a

468
00:24:57.200 --> 00:25:01.000
terrible grandmother. She sentenced her to life with the possibility

469
00:25:01.000 --> 00:25:05.880
of parole after twenty four years. Shawn's celebration of life

470
00:25:05.960 --> 00:25:09.000
was held at the Westgate Hotel on Saturday, May fourth,

471
00:25:09.240 --> 00:25:13.039
twenty nineteen. Chris asked that it be a true celebration

472
00:25:13.119 --> 00:25:15.759
of life and said, please come dress to rock and

473
00:25:15.839 --> 00:25:19.240
let's send Sean to Valahalla style. Hundreds of people came

474
00:25:19.240 --> 00:25:22.359
from across the country. The event was appropriately filled with

475
00:25:22.400 --> 00:25:26.279
lots of music, which was a huge part of Shawn's life.

476
00:25:26.400 --> 00:25:28.839
Later that summer, a video game music festival in San

477
00:25:28.880 --> 00:25:31.559
Diego was performed in his memory, with some of Sewn's

478
00:25:31.599 --> 00:25:35.000
former bandmates and attendance. Shawn's story is one we wanted

479
00:25:35.000 --> 00:25:37.279
to share, not only because he was an exceptional person

480
00:25:37.319 --> 00:25:39.839
who was loved by so many, but also because it's

481
00:25:39.880 --> 00:25:43.039
another example of how child custody disputes can turn violent.

482
00:25:44.039 --> 00:25:46.160
In hindsight, it was never a good idea to have

483
00:25:46.240 --> 00:25:50.039
Bordeaux supervised visitation, and it definitely wasn't a good idea

484
00:25:50.319 --> 00:25:52.960
for it to be in an isolated place like Bordeaux's

485
00:25:53.000 --> 00:25:56.200
own home. I can imagine what a tense and ominous

486
00:25:56.279 --> 00:25:59.000
environment that was for Sean to have to spend limited

487
00:25:59.039 --> 00:26:02.039
time with his son with Pamela sitting there with her gun,

488
00:26:02.160 --> 00:26:06.240
pepper spray and handcuffs. The fact of the matter was

489
00:26:06.319 --> 00:26:08.640
that if anything had ever happened, it would always have

490
00:26:08.720 --> 00:26:11.599
been his word against hers, and neither of them would

491
00:26:11.640 --> 00:26:16.240
have had any protection if any accusations were raised. While

492
00:26:16.240 --> 00:26:18.839
this probably seemed to be a very reasonable arrangement for

493
00:26:18.880 --> 00:26:21.200
the family Court at the time it was created, since

494
00:26:21.200 --> 00:26:24.359
Sean's son was just a small infant, but this truly

495
00:26:24.359 --> 00:26:27.720
put all four of them at risk. We hope that

496
00:26:27.759 --> 00:26:30.400
Shawn's family has had the opportunity to build a relationship
